What is the first legal filing?

Often the state formation document, but founders should validate the mission, board, name, and structure before filing. The correct order depends on the jurisdiction.

Is an EIN the same as 501(c)(3) status?

No. An EIN identifies the organization for federal tax administration. It does not create the corporation or grant tax-exempt recognition.

When do we register to fundraise?

State requirements differ. Some require registration before soliciting contributions. Check every state where fundraising will occur.

How should we save formation records?

Maintain a permanent, access-controlled record book containing the Articles, bylaws, policies, minutes, EIN notice, applications, determinations, annual filings, and major contracts.
